Beta Terms of Use

§ 1 Scope and Beta Status

These Beta Terms of Use (hereinafter "Beta Terms") govern the use of the platform host‑x.de (hereinafter "Service") under the domain www.host-x.de during the active beta phase. The provider is HOST-X, Unter den Linden 24, 10117 Berlin (hereinafter "Provider").

The Service is under active development. By using the Service, you expressly accept these Beta Terms. They apply in addition to the general Terms of Use; in case of conflict, the Beta Terms shall prevail.

These Beta Terms remain in effect until the Provider announces the official production launch and regular terms of service come into force.

§ 2 Access and Registration in the Closed Beta Phase

Access to the beta version is granted exclusively by personal invitation or with the Provider's express approval. Public registration is not available during the closed beta phase. The Provider reserves the right to restrict, suspend, or permanently revoke access at any time and without stating reasons — including without prior notice.

By registering, you acknowledge that:

• this is a platform under active development that may contain bugs, outages, and data loss;
• features, limits, and functionality may be changed, restricted, or removed at any time;
• there is no entitlement to continued access or the retention of specific features;
• stored data may be reset or deleted (e.g. during database migrations).

§ 3 Service Scope and Availability

The Provider makes the Service available during the beta phase without any guarantee of availability or stability. There are no obligations regarding service level agreements (SLAs), response times, or uptime guarantees.

The Provider is entitled to shut down, interrupt, or fundamentally change the Service at any time — including without notice — in particular for:

• maintenance and updates;
• database migrations or infrastructure changes;
• security or stability measures;
• fundamental changes to the product.

§ 4 Quotas and Usage Limits

During the beta phase, the following usage limits may apply and are subject to change at any time without notice:

• Domains: The number of manageable domains and DNS records may be limited or expanded;
• Email mailboxes: Storage space, number of mailboxes, and filter rules may vary;
• Web hosting: Storage quotas, traffic limits, and PHP versions are subject to change;
• Data retention: Retention periods for backups and logs may be changed without notice.

The Provider will endeavour to give reasonable advance notice of significant quota changes via email or in-app message, but is not obligated to do so.

§ 5 Free of Charge and Future Pricing

Use during the beta phase is generally free of charge unless explicitly stated otherwise. Costs arise only for optional premium features that are marked as paid.

After the beta phase ends, the Provider reserves the right to introduce a paid model. Existing beta users will be informed at least 30 days in advance and may receive special terms.

§ 6 Feedback and Participation

Beta users are expressly invited to report bugs, submit improvement suggestions, and actively participate in the development process. Feedback can be submitted via the Beta Programme, the contact form, or by email.

By submitting feedback, ideas, or suggestions, you grant the Provider a royalty-free, worldwide, transferable, and perpetual right to use them for the further development of the Service. No claim to compensation or attribution exists.

§ 7 Confidentiality

Beta users agree to treat all non-publicly accessible information about the Service as confidential and not to disclose it to third parties or make it public.

This includes in particular:

• screenshots, screen recordings, and other depictions of the beta version;
• credentials, internal links, and technical information;
• unreleased features, prices, concepts, and documentation;
• information about bugs, security vulnerabilities, or internal processes.

The confidentiality obligation continues for three years after the end of the beta phase, insofar as the relevant information has not already become lawfully public knowledge.

§ 8 Limitation of Liability During the Beta Phase

The Service is provided during the beta phase "as-is". The Provider assumes no liability for:

• data loss caused by bugs, crashes, or migrations;
• outages, interruptions, or malfunctions of the Service;
• incorrect or incomplete configurations and settings;
• lost profits or other indirect damages resulting from use of the beta service;
• changes to or removal of features.

Liability for damages arising from injury to life, body, or health, as well as for intent and gross negligence, remains unaffected.

§ 9 Privacy

The collection and processing of personal data is carried out in accordance with the Provider's Privacy Policy. During the beta phase, extended usage data (e.g. click paths, error logs) may be collected for analysis and improvement purposes. This is disclosed transparently in the Privacy Policy.

§ 10 Termination and End of the Beta Phase

You may terminate your use of the Service at any time by deleting your account or by informal notice to the Provider.

The Provider is entitled to end the beta phase at any time and:

• permanently discontinue the Service;
• transition the Service to regular operation (in which case the regular terms of service apply);
• deactivate individual user accounts if they violate these Beta Terms.

In the event of discontinuation, beta users will be informed at least 14 days in advance, provided circumstances permit.

§ 11 Amendments to the Beta Terms

The Provider reserves the right to amend these Beta Terms at any time with effect for the future. Changes will be communicated by email or by a notice within the Service. Continued use of the Service after such a change constitutes acceptance of the amended version.

§ 12 Severability

Should any individual provisions of these Beta Terms be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid rule that comes closest to the economic purpose intended.

§ 13 Governing Law and Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from this agreement is Berlin, provided the customer is a merchant, a legal entity under public law, or a special fund under public law, or has no general place of jurisdiction in Germany. For consumers, the statutory place of jurisdiction applies.
